Thank you both for the response. Yes, the new filing fees apply as you rightly said and I was able to Efile also.
The link below was useful in efiling. Just one variation though, USCIS schedules the biometrics appointment, so no need to call the 800 # to schedule one as mentioned in the link.

Until now, new inmates booked into the San Diego County Sheriff’s Department had their fingerprints checked only for criminal history information. But now, each new inmate booked into one of the three largest jails in the County will now also have his or her fingerprints checked by the U.S. Department of Homeland Security’s (DHS) biometric system for any immigration record.
The San Diego County Sheriff’s Department is the first law enforcement organization in California to partner with the U.S. Immigration and Customs Enforcement (ICE) in their Secure Communities program. This comprehensive program is intended to streamline the process by which ICE determines if the screened inmate is a criminal alien, subject to automatic removal at the completion of his or her incarceration. Highest priority is given to inmate aliens who have been convicted of crimes such as rape, robbery, murder, kidnapping, and major drug offenses.
By implementing programs like Secure Communities in prison facilities and law enforcement organizations, ICE identified more than 221,000 potentially removable aliens incarcerated nationwide in fiscal year 2008. This fiscal year, the agency anticipates spending more than one billion to continue these programs. ICE currently partners with 50 counties and law enforcement agencies across the nation through the Secure Communities program and looks to expand the program to all law enforcement agencies throughout the United States.

As I understand a new bill has to be introduced in Senate and in House of Representatives. Both these bills will have to be passed and then reconciled for differences.
Is it true that all CIR legislation that was introduced in Senate last year is now dead and that a new bill will have to be introduced in Senate as well?

My case was approved on Aug 19, 2010. I received my card on Aug 26, 2010.
Unfortunately, The EAD card had a wrong start date. I have sent my cards back for correction on Sept 2, 2010.
(I do have approval e-mail of my cards and the case.)
So, Question is, Can I work while my cards come back with the correct date. I don't have receipt of the replacement cards in my hand yet.
Please let me know.

you need to be in possession of the card to work. the fact that you sent the card back does not make you eligible to work, as the card had dates that were wrong. what were the wrong dates? you can work only for the dates that the card was approved for, provided you have the card in your possession.

You will be able to return to same employer if you get employed again with your old employer.
Alternatively, you can file new H1 with a new employer. YOu dont need to go visa stamping, but your son need to go in either case.
Make sure you either have a project with client letter or your employer has position to employ you on genuine internal project that can be documented well. Its not question of past pay stubs for you. Its about having valid and verifiable employment now.

My wife is maintaining her H4 status since Feb 07 and last entered US on H4 visa in July 2010, we have our EAD cards based on pending I485 filed in Aug 07. Her AP is valid till Jan 2011 and I am on H1B. she started working on EAD couple of weeks ago.
My question is: does the fact that she entered last on H4 affects her ability to work on EAD? Will it cause any problems in I485 approval.
Since she is working on EAD, her status is no longer H4 (the new status is AOS, so to speak). Other than that, there is no issue.

Can spouse leave to home country after filing concurrent i140 and 485 application?
Her and mine application (concurrent 140 and 485) was filed on July 2nd, 2007but I have not received RECEIPT # yet. Can my spouse leave USA or we have to have get Receipt # first ?

I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.

I have heard about many COS applications getting approved, so you have a good chance.
The only thing I would recommend is make sure your H4 is valid for a relatively long time going forward. This will ensure that even if F1 COS does not get approved you atleast are in status throughou the process.
This is because sometimes the processs can take a long time eg. My spouse's COS from H4-F1 never got approved (name check etc etc took 2+ years), so we withdrew after the completion of the degree. Meanwhile the H4 had expired, creating complications.

Please help me to get out of this confusion.
My H4-H1 Adjustment of status is approved and i have Advance parole and EAD with me through my husbands i485 application.I need to travel to india in jan/feb 2008 for 2-3weeks.I may not be able to go for stamping at that time.My H4 visa stamp is valid till sep2008.My H1 approval notice is valid till sep2010.
My question is,can i travel to india and come back without H1 stamping using Advance parole?If i come in using Advance parole can i work again on H1 or do i need to use EAD?

You can stay here as long as the I797 is valid (there is no rule to stamp it within a year). Do you have H1B stamped frome before or is this your first H1? If the first one then you have to get it stamped when you travel out of US. If this is not the first one then you can travel back on your old H1 stamp with new I797.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card.
