Hi,
is it absolutely safe to travel with pending i 485 app with valid h1b stamping with receipt notice and completed fp.?we are kind of confuded whether to plan for the travel...We have not yet received the actual advance parole. i read somwhere that if u leave the country wth pending i 485 but without ap ur appl is considered abandoned.is this true.?..we have the option to change the trip to apr too.In a nutshell is it completely safe to travel on 485 pending appl without ap with valid stamping.?:confused:
Has any1 wth the same situation has gone and come back without any issues?

My wife got her H1B in Oct 2008. But could not work until date.
We want to get her H1B transferred back to H4. There are NO pay stubs for her.
I am on H1B with job. And I have my pay stubs.

You can use EAD with current employer. I think your company has to do the change your I9 form to EAD. You don't need to inform as you are not changing any company.

I believe the folks from electric rain would be the first to tell you that they don't really play in that game. Try importing artwork from Illustrator. The best answer is to go with a true 3d modeling program. There are plenty out there...

I got my EAD renewed recently and by mistake I have interchanged my First Name and Last Name in the application. I received an approved EAD card also with the First Name and Last Name interchanged.
I noticed the problem only when I went to renew my Drivers License.
My questions are
1) What is the process to get the names rectified on an approved EAD
2) If I leave it as it, will it create any issues.

An A# is allotted whenever you file for AOS (either employment or relationship based or any other category eligible) and the USCIS accepts your I-485. This will be your A# for the rest of your life and will be on any subsequent filings (irrespective of the category .. immigrant or non-immigrant) with the USCIS.
I am not really sure about the A# allotted when you file for F1/OPT (I never had an F1). Please check with a qualified legal specialist.

I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.
You will need to have the petitioner file an amended petition only if there has been a material change in the terms and conditions of your employment.
Compare the job duties (not just job titles) of the original and new job to determine if they are in the same Standard Occupational Classification (SOC). See, Find Occupations (http://online.onetcenter.org/find/). If the jobs are in the same SOC, they would both have the same prevailing wage and no material change has occurred. In that case, you may only need to get a new LCA. All LCAs take up to 7 business days to get certified by the DOL. Why not microsoft? The rest of high tech industry will not survive if they can't move their 60% of operations outside of USA. Bone headed congress will continue to come up with legislation that encourage illegal immigration and discourage legal immigration.
