Unless you are getting your mother-in-law to the US before you get your GC, it may become a factor but otherwise, it will have no issue

Maybe some of you can help me with my problem. I was directly hired to work in the US with two other colleagues. Our PD was April 04. We got our LC�s last year. My two friends and I applied for I-140 last December 2006. (same job, same employer sponsoring us). The two got their I-140 by June and were able to receive their GC courtesy of the July fiasco.
Last May 07, I was told that I was mailed an RFE. I never received it. As you may know, you can only follow this up after a month. Three phone calls (and months) and two faxes (two months) later, still no letter. My lawyer is at his wits� ends. The other day, he gets an appointment at a USCIS center near our area. He says this office �has no jurisdiction over my case� and that this was a long shot. An immigration officer looks at the computer system in the office and says that the system�s list of RFE cases does not include my name, and perhaps there was an error. Perhaps�
Has anybody heard of a similar case? My lawyer is now suggesting that I write a congressman for help. Do you think this will help?

Thanks, Greenways. After seeing your post I called my attorney right away. The office assistant informed me that my 140 has been approved on August 27th 2008 and sent me a copy of the approval notice.:):):):):):):)

CRIS still shows that my case status as application received and pending, although there was a soft LUD on august 27th on my 140 application, which is the approval date of my 140. I failed to understand the meaning of the soft LUD at that time, but now I know. So, my dear friends, do not rely on CRIS for updates. Please check with your employer/attorney to get the latest status.

Unless you know the outcome, you never know.
Just be candid and talk to your employer. Sometimes they don't even know this as diff ppl in HR handle and interpret cases differently. I would talk to my employer.
my employer has no clue whether it can be done or not. however i posted this same Q to my attorney. i am waiting for the response from him. If anyone else have any inputs, i would appreciate it.

I think this is a step forward...but aint cutting it...your status remains "in process for years"...everyday check the same url and it says gives the same stale status...what we need is a way to make a resonably accurate guess as to when my LC will go into the next stage..

- H1B is good as long as employer-employee relationship is maintained, which in your case should be fine
- You may have issues with 140 approval (Just my opinion, I may be wrong)
- If you are considering H1 transfer, that may have issues as you may not have latest paycheck..

My labor was filed with job title from the employer as IT Lead (O*Net Code - 11-3021.00, O*Net title - Computer and Information Systems Managers). I am having an opportunity to convert to full-time on EAD (I-140 approved, EAD received 18months back). The new job title is Software Engineer(possible O*Net codes - 15-1032.00/15-1021.00/15-1031.00, possible O*Net title - Computer Software Engineer/Computer Programmer). Is it possible to file AC21 in this scenario. The salary and the job descriptions for both the Labor filing and the new opportunity are similar. I am worried if the title might cause a problem. I have to make a decision very soon. Please help.
as far i have learnt from the discussions in forms "Title" should not be a problem.
But the O*Net Code should be the same.
Meaning new job should fall under the same job code.

I have been noticing a lot of people moving changing jobs using EAD. Especially a lot of June and July 2007 filers.
The time to renew EAD is approaching and I am sure there is going to be a surge in EAD renewals.
There was also a recent communication from USCIS that one must not apply for renewal prior to 120 days of their EAD expiry date.
In past has anyone been in a situation where they are not able to renew EAD in time and how you handled it?
Do you plan to apply for EAD exactly in the 120 day range to make best use of time? What if EAD renewal gets severly backlogged?
I think this is something we must all concentrate on and try to get some answers from USCIS on this as it will help planning.

Of course you can start PERM in your 6th year. Make sure you do it soon and file for I-140 promptly so that once that is approved you can get 3 yr H1 approval

Hotel News Now, a leading Global Hospitality publication, ran a two-part series about staffing challenges facing the U.S. hotel industry. I was honored to be interviewed by the publication and share my insights on the problems facing hospitality employer in these challenging times.
With the level of unemployment about 8.5 percent, why do hotels still need foreign workers? There are various reasons, from location to the attitudes of American workers. And changes in schedules and lifestyle have affected one of the former staples of summer work�students.
The situation is bad for staffing professionals in the industry, said Jacob Sapochnick, a San Diego, California-based lawyer whose practice is devoted to immigration law. �Even though they can hire local people, they can never rely on them for the full term,� he said. �If you have a large hotel, need 50 housekeepers and hire locally, the turnover is very high. They find a better job or one that pays more. When you have H-2B workers, they know they have them for 10 months. Their visa depends on them working at that hotel.�
The more turnover, the less likely the hotel will function properly, Sapochnick said.

Dealsnet is correct. Your wife should have no problem entering if she has a valid AP.
