Hi,
I am working under H1B visa and got married December last year. My wife applied for her H4 visa this month and when she got to the embassy for the interview, the consul checked and commented on the font size of her address in our marriage certificate. She said it was smaller than my address (well, she got a longer address before we got married, maybe that is why the census made it smaller) and said to my wife that it needs verification. The embassy then took all documents (her passport, our original marriage cert, etc.) and said they will call her when she needs to return for interview again.
Has anyone of you experience this? If so, any ideas how long it takes for them to call? BTW I'm Filipino. Thank you guys and God bless

Unfortunately , it is true. I personally know a friend whose I-485 was denied even without issuing any NOID or RFE. Reason, well its very obvious, the underlying I-140 was revoked, even though it was past 180 days. By law, your supposed to get NOID or RFE. but some IOs are ignorant and do not know the AC21 laws properly. So they issue straight denial. The number of cases are few because not many companies revoke I-140 past 180 days. But few companies do and some have to do it. So in these situation yes, chances are that you will get a straight denial and that is why there is thread to lobby efforts to raise some concerns to Ombudsman about these erroneous denials.

I know I may sound stupid and probably the answer is that it is already complete, but wanted to confirm.
Also, when would the next years quota become available and when can one start working at the earliest ?
Is there any other way to file for H1-B now and work..?

This is same rule in MN too. My wife extend her H4 with dirver license. You need to get her H1b approval first and then renew her license with new H1b Expiration Date. Hope this will help.

I have an employee who was a student and then got employment authorization. She asked me to begin the process of getting her an H1B; but then we determined that she really wanted a green card. Can I use the LCA I got for her H1B to apply for her I-i40?
LAC for H1B and LCA for Green card are entirely different .

Yes, If you have enough Money, Usally 8,000-10,000 $ in the bank statement( This is checked for covering any Medical Bills etc when they are here, just to make sure that the sponser is able to take care of all these when they are in US), That would be enough for you to sponser them.

She has the F1 stamped on the passport which is valid until Dec 2009 I think. She is finishing much before that. Does it mean she will not be able to reenter on either F1 visa or the EAD?

My company would like to send me France on business.
But My H1 visa expired Jan 2006.
I got H1 approval up 2009 but passport is not stamped.
My lawyer told me that I can go to Paris (France) and visa stamped.
I am not sure France consulate will issue me visa to enter France.
Any comments and any input?

my kids received finger print notice in 1st week of feb 2008 where as my self and my husband got it in Oct 2007
and we were told by my attorney FP is not required for kids below 14 0r so
we didnot try to call USCIS

Hi All,
I need to travel urgently to India due to some family issue and my EAD is expiring in Aug 2010. I need to apply for my renewal before I fly out this Sunday since I will have to be in India for 30 days. Can I e file my application from here and send the supporting documentation by Saturday? If so, I want to make sure that if for some reason, I get a biometrics appt., while in India, how can I postpone it? and also there won't be any issues with my EAD renewal app since I will be India and My I 94 will change once I am back.

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.

Me and My friend developed a product, which is ready to launch. The product is very good and two fortune 500companies are willing to implement the product and back us up.
Now my problem is I am on H1B working fulltime with a company and also have an EAD. At this moment I cannot leave my fulltime job. My question is , if I can be a partner with my friend in the new company we are forming( My friend is a US citizen), also will I be able to get paid ( as the developement of the product drained my pocket, this was the hope and I think we are close to reap the hardwork) . Also my wife is also on EAD , can she be the partner? Will there be any issue if I can do that.

Today I will be giving a presentation on immigration law along with my colleague, V. Thomas Langford, to the Air Force JAG serving at Travis Air Force Base in Fairfield, California. The Air Force JAG Corps are lawyers who provide legal advice to those serving in the Air Force.
Our training today will focus on the basics of immigration law. We will be covering family-based immigration law and outlining the procedures involved in petitioning for a family member to immigrate to the United States. We will also be talking about the Violence Against Women Act ("VAWA") and how an individual may self-petition for immigration status if he or she has been the victim of abuse or mental cruelty. Finally, we will discuss the naturalization laws as they apply to those serving in the military at a time of a conflict.
It seems that I always learn something while preparing for a presentation. While preparing for this one, I learned that staff from USCIS in Sacramento go to Travis Air Force Base twice a month to interview applicants for naturalization and administer the oath of citizenship on the same day. Kudos to USCIS for taking the time to do this. I want to extend the stay for my Parents for few months. They are on visitors visa. I am aware that I need to file form I - 539 for this purpose. I am not sure what reason should I specify for extention?
If some one had done extention for visitors visa in past please, I would appereciate your help on this.

Also, dont specify Medical emergencies. They sometimes ask you to provide letters from the doctors regarding this. You can just say that they need some more time to visit places.
Ideally, I wouldnt recommend, having them overstay. This might have issues in the future, if they plan to visit again.
If they have a 5 or 10 year multiple entry visas, they can go back home and come again in another 6 months or so.
If some one had done extention for visitors visa in past please, I would appereciate your help on this.

Did you receive the compensation at all? If so, the deposit slips from your bank may be a possibility as proof of payments. If you haven't been paid at all, you might be a victim of a bad employer and you should report the employer to Department of Labor in US.
If you are now entering US on L-2, there should not be any questions around your earlier H1-B, but the IO can always ask about your earlier stays in US and hold you up. Ask your employer to provide you a certificate on company letterhead with authorized signature stating the compensation provided to you while on H1-B, though 'I lost your paystubs' is a really flimsy excuse... ;)
Please consult a good lawyer before making any decision...
