Im just thinking aloud here. We want to be heard and we want to educate people as to how we are different from Illegal immigrants.
Why not post a question for the Republican debate? If our questions get selected and aired we will have 30 seconds of national television audience. We might even get some answers from some presidential candidates.
What i have in mind is get a few of us together, preferably people from different nationalities. Each one of us will hold a placard with
Legal Immigrant in bold, educational qualification, Federal tax paid, State tax paid, SSN tax paid and finally number of years in green card wait.
One person.. can then briefly mention what our issues are and ask what the candidate can do for us.
Each placard also has immigrationvoice.org on it...we have free advertising, we have airtime for free... and we have a national audience.
I know very well that the candidates answer may not directly help us.. but at least we will get some attention. Many many citizens watch the debate.

Foreign nationals who have stayed in the United States after the expiration of their period of authorized stay or are present in the United States without being admitted or paroled are unlawfully present in the U.S.
If more than 180 days but less than a year of unlawful presence accrues, then the foreign national is inadmissible for three years (three year bar). Foreign nationals who are unlawfully present for one year or more are inadmissible for 10 years (10 year bar). If a foreign national has accrued unlawful presence in the United States, then they are deemed inadmissible and illegible to re-enter the U.S. for either the three year or 10 year bar from the date they leave the U.S.
There is a waiver available for the unlawful presence ground of inadmissibility. Essentially the waiver will waive the three and 10 year bar of inadmissibility. The waiver is only available to foreign nationals with a U.S. citizen or lawful permanent resident (LPR) spouse or parent. Children are not deemed qualifying relatives for the waiver. The first step in the waiver process is for the foreign national to attend an immigrant visa consular interview in their home country. Once the consular officer deems the foreign national is inadmissible and a waiver is available, the foreign national will then file the waiver (form I-601, with the applicable filing fee) and establish there is extreme hardship to the U.S. citizen or LPR spouse or parent if the foreign national were not allowed to return to the United States. The waiver request is discretionary and extreme hardship is only one factor the officer will consider.

Don't panic. It will be alright you can resubmit the correct fee you have 30 days to do that. Sometimes USCIS can make mistakes even you submitted correct fee.

My I-140 is also pending in Nebraska, I am also in EB-3 category with labor PD 02/20/2007. Your labor PD is 03/2007 and hence it is surprising! I saw an approval for one EB-3 filed in April 2007 in but his PD is 2002.
I do not see any LUD these days in my pending I-140 and I-485. There was a soft LUD in my wife's I-765 (EAD already approved and received) about a month back.
Please keep us updated.

I believe what you need to show is the company's P&L statement with revenue statement, and not just $7000 in profit. if the company has a revenue of $1mil or more, it should be fine, if less then it needs to show how many employees it had and what profit or loss it made....it should be at least $1.0 profit, rather than a loss.

Hi,
I have applied for my wife's AP with NSC today and She needs to travel on April 3rd. I wanted to know how long does it take these days for approval?
Also, if she does not get the AP by April 3rd she would be travelling anyway. Because, I can mail her the AP once we receive even after her departure as I am going to be here in US. My question is if she travels out of the country before the approval, would USCIS know about it and would it affect her application? And if it does not come at all, can she apply for H4 stamping in India and come back on it? Please let me know guys.

What are those little green squares that show up with our names when we post something?? When you hover over them you see a ToolTip message.

Due to Iceland's volcanic ash my MIL trip has to be postponed. She was on visitor visa. We filed an extension with USCIS and paid $300. She left US as soon as flights started to resume.
USCIS approved her extension 30 days after she left US.
a) Can we seek a refund because this extension has to be filled due to reasons beyond our control
b) In the future how to seek a fee waiver (any tips or advice please).
c) Can we seek fee waiver when we e-file a petition.

I ran into a very strange situation today. I have been working for a big reputed company for several years. I started as an engineer and now I am an engineering manager. My labor was filed when I was engineer. Recently my lawyers found out that my position has changed and they are rigorously working to file amendment(I think this is AC21). Lawyers convinced HR that this doesn;'t impact my application - but I highly doubt that given the history of issues I had with these lawyers. Please let me know your opinion on the possibility of my application either getting rejected or getting delayed due to this change. One good this is my field hasn;t changed - I am still working in the same filed listed in my labor application.
My application is pre-approved and waiting for visa number.I am also thinking about getting back to software engineer position to avoid all the potential trouble, but my career is going to take two steps backwards.

I am in the process of moving between jobs. The old job is a teaching job in a university and the new one is a research position in a non-profit think tank. So there is no H1B quota issue for both jobs.
The H1B for the old job won't expire unit next year. I have received the H1B for the new job. The start date for the new H1B is Sept. 1st.
My question is: Can I start my new job before Sept. 1st? I understand that for H1B transfer, one can start the new job once the application receipt from USCIS is received. But in my case, I have already got the new H1B and the start date on that is Sept 1st.
